1. Definitions

"Nous", "notre" et "Auction Star" refer to the company operating AuctionStar.ca.

"Vous" ou "Utilisateur" refers to anyone accessing the site, registering, or using our services.

"Vendeur" refers to anyone or entity offering goods for sale on our platform.

"Acheteur" refers to anyone or entity placing a bid or buying goods via our platform.

2. Site Use

  • Use of our site is reserved for individuals legally able to enter contracts.
  • You agree not to use this site for illegal purposes or in violation of these terms.
  • You agree to provide accurate and complete information during registration and keep it up to date.

3. Auction and Sales Process

  • Auction Star acts as a platform facilitating connections between sellers and buyers.
  • We are not responsible for the quality, authenticity, legality, or condition of items listed for sale.
  • All bids are firm and final. Once your bid is placed and accepted, you are legally obligated to complete the purchase.

4. Payments and Taxes

  • Payment terms are defined for each sale.
  • Buyers are responsible for all applicable taxes (GST, QST, other local taxes).
  • Additional fees may apply, such as transaction or processing fees.

5. Delivery and Pickup

  • Delivery or pickup terms are specified for each sale.
  • Buyers are responsible for transport and costs related to pickup of purchased items.
  • Auction Star does not guarantee delivery times.

6. Intellectual Property

All content on AuctionStar.ca (texts, images, logos, videos) is protected by intellectual property laws.

Any unauthorized reproduction or use is strictly prohibited.

7. Lot Availability, Errors and Cancellation of Sales Clause

The seller and/or the platform reserves the right, at its sole discretion, to remove, modify, suspend, or cancel any lot displayed on the site before, during, or after an auction, without prior notice.

Without limiting the foregoing, the seller and/or the platform may cancel any bid, award, or transaction in the following cases:

  • administrative or human error;
  • pricing error;
  • description error;
  • photography error;
  • inventory error;
  • lot lost, stolen, damaged, or no longer available;
  • technical or system issue;
  • auction system malfunction;
  • fraud or suspected fraud;
  • abuse of the platform;
  • any event beyond the reasonable control of the seller or the platform.

If a lot is no longer available or a transaction is cancelled for any of the above reasons, the seller’s and platform’s liability shall be strictly limited to a full refund of amounts paid for that lot.

The buyer acknowledges and agrees that no additional compensation, direct or indirect damages, loss of profit, travel expenses, loss of opportunity, or any other claim may be requested from the seller or the platform following such cancellation.

The full refund of amounts paid constitutes the buyer’s sole and exclusive remedy.

The seller and the platform do not guarantee continuous availability of listed lots and reserve the right to correct any error or omission at any time.

The seller and the platform shall not be held liable for typographical errors, data entry errors, system errors, programming errors, service interruptions, system failures, or any other event affecting the normal course of an auction.

By participating in an auction, each bidder acknowledges that information published about lots is provided in good faith but may contain errors, omissions, or inaccuracies.

The bidder agrees that the platform and seller may correct such errors at any time, even after the auction has closed or after payment has been processed.

The seller and the platform reserve the right to refuse, suspend, cancel, or invalidate any bid, user account, or transaction when they determine that an exceptional situation, error, or circumstance compromises the integrity of the auction or makes normal execution impossible.

8. Limitation de Responsabilité

Auction Star cannot be held liable for direct or indirect damages related to site use or purchase of goods via the platform.

We do not guarantee error-free site operation or uninterrupted access to our services.

9. Modifications des Conditions

Auction Star reserves the right to modify these terms at any time.

Changes take effect upon posting on the site. It is your responsibility to review this page regularly.

10. Droit Applicable

These terms are governed by the laws of the Province of Quebec and applicable Canadian laws.

Any disputes regarding site use will be subject to the exclusive jurisdiction of Montreal courts.
